Client Accounts

Account Creation

To access certain Services, you may need to create an account. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You agree to:

  • Keep your password and account information secure

  • Notify us immediately of any unauthorised use of your account

  • Ensure you exit from your account at the end of each session

  • Not share your account with any third party

Service Terms

Service Delivery

  1. Appointment Scheduling: All appointments must be scheduled in advance and are subject to consultant availability.

  2. Cancellations and Rescheduling:

    • Appointments must be canceled or rescheduled at least 24 hours in advance.

    • Late cancellations or missed appointments may result in the session being counted as delivered with no refund.

  3. Service Package Terms:

    • Service packages must be used within the specified timeframe from purchase date.

    • Unused services within a package may expire according to the terms specified at purchase.

  4. Materials and Resources:

    • Materials provided during service delivery are for personal use only.

    • We reserve the right to limit access to certain proprietary resources.

Client Responsibilities

As a client, you agree to:

  1. Provide accurate and timely information necessary for service delivery

  2. Respond promptly to requests for information or materials

  3. Attend scheduled appointments punctually

  4. Complete assigned tasks and action items as recommended

  5. Respect the professional boundaries of our consultants and staff

  6. Engage with our Services in good faith and with honest intentions

Student Progress and Results

Merton Education does not guarantee specific outcomes, including but not limited to university admission, test scores, or academic achievement. Our Services are advisory in nature, and results depend on multiple factors, including the Student’s efforts, abilities, and factors outside our control.

Payment Terms

Service Fees

  1. Our fees are as specified on our website, in service contracts, or as quoted by our representatives.

  2. All fees are subject to change at our discretion. Changes will not affect prepaid services.

Payment Methods

  1. We accept payment via credit card, bank transfer, or other methods specified on our website.

  2. For recurring services, you authorize us to charge the payment method on file.

Refund Policy

  1. Full Refunds: Available within 7 days of initial service purchase if no services have been delivered.

  2. Partial Refunds: May be available on a prorated basis for unused services within a package, subject to administrative fees.

  3. Non-Refundable Items: Certain services, including but not limited to emergency consultations, late-stage application reviews, and services already delivered, are non-refundable.

  4. Dispute Process: Refund disputes must be submitted in writing to our customer service department.

Client Materials

Your Obligation

Limitation of Liability

Service Limitations

  2. Does not guarantee admission to any university or achievement of specific academic outcomes

  3. Is not responsible for decisions made by educational institutions regarding admissions

Liability Cap

Our maximum liability to you for any claim arising from or related to our Services shall not exceed the amount you paid for the specific Service giving rise to the claim.

Exclusions

We are not liable for:

  1. Indirect, consequential, special, or punitive damages

  2. Loss of opportunity, admission chances, or academic standing

  3. Damages resulting from your failure to follow our advice or recommendations

Indemnification

You agree to indemnify, defend, and hold harmless Merton Education and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  1. Your violation of these Terms

  2. Your violation of any third-party right

  3. Your misuse of our Services

  4. Any content or information you provide to us

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website with a new “Last Updated” date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.

Force Majeure

Neither party shall be liable for failure or delay in performing obligations due to causes beyond reasonable control, including but not limited to natural disasters, pandemics, governmental actions, wars, terrorism, riots, labor disputes, or internet service provider failures.
